Welcome to www.topCOREagent.com (the “Website”), operated by RealTech Solutions, LLC (“RealTech,” “we,” “us,” or “our”), a Florida limited liability company located in Old Town, FL 32680. These Terms of Use (“Terms”) govern your access to and use of the Website and the products and services offered through it, including its products & services offered (collectively, the “Services”). By accessing or using the Website or Services, you (“User,” “you,” or “your”) agree to be bound by these Terms. If you do not agree with these Terms, you must not use the Website or Services.

1. ELIGIBILITY
You must be at least 18 years old, have the legal capacity to enter into contracts. You do not need to be a licensed real estate agent to make a purchase, but the services may only be fulfilled within an active BoldTrail/kvCORE® account. By using the Website, you represent and warrant that you meet these eligibility requirements.

2. DESCRIPTION OF SERVICES
RealTech provides the following Services through the Website, available to Users in the United States and Canada only:

2.1 Smarter Campaigns
Smarter Campaigns provides access to copyrighted articles hosted on MyRealEstateContent.com for use by Users to share with their customers. Upon purchase, Users will receive an account on the Website and must complete required action items in “My Account” to enable fulfillment, including providing temporary access to their BoldTrail/kvCORE® account and customizing branded banners with their photo, name, contact information, company logo, and up to five (5) optional links. The articles include sharing buttons for social media, email, or printing, and the URL may also be shared. Users may use the articles or portions thereof in other media, provided the copyright notice (“Copyright [Year]. All Rights Reserved. RealTech Solutions, LLC”) is included. Articles may not be resold or licensed to third parties. Access to articles and branded content will remain available regardless of User’s chosen brokerage, but drip campaigns created by RealTech may no longer be available if User loses access to their BoldTrail/kvCORE® account. Smarter Campaigns are made available with a one-time purchase, and RealTech may add new content at its discretion, which may be included with the original purchase or offered for an additional fee.

2.2 Landing Pages
Landing Pages entails the creation of a set of web pages (3, 5, or 10) for the purpose of User to obtain leads. After purchase, Users must select their preferred landing pages through “My Account” in the Website and also provide temporary access to their BoldTrail/kvCORE® account for implementation. Landing pages will be hosted on the User’s BoldTrail/kvCORE® account, and RealTech has no control over their availability or performance after creation. Landing pages are copyrighted by RealTech Solutions, LLC and may not be resold, redistributed, or shared. User, however, will own full rights to any leads generated through the landing pages, which are stored directly in their BoldTrail/kvCORE® account.

3. USER ACCOUNTS AND RESPONSIBILITIES

  • Account Creation: To purchase and use the Services, you must create an account on the Website and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
  • Action Items: Fulfillment of Services requires you to complete required action items in “My Account”, and action items will depend on product(s) or service(s) purchased. You are also responsible for ensuring RealTech has temporary access to your BoldTrail/kvCORE® account in order to fulfill the Services.
  • Account Security: You agree to notify RealTech immediately at Support@topCOREagent.com if you suspect unauthorized access to your account. RealTech is not liable for any loss or damage arising from your failure to secure your account.
  • Cancellation: You may cancel your account at any time by providing notice to Support@topCOREagent.com. Before removing your account, RealTech will send a confirmation email to the email address on record as an additional security measure.

4. INTELLECTUAL PROPERTY

  • Ownership: All content provided through the Services, including articles, landing pages, text, images, and branded banners, is owned by RealTech Solutions, LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws.
  • License for Smarter Campaigns: Subject to these Terms, RealTech grants you a non-exclusive, non-transferable license to use, reproduce, and share the articles provided through Smarter Campaigns for your business purposes, provided the copyright notice is included. This license is non-revocable unless you violate these Terms (e.g., by reselling or distributing the articles). You may not sublicense the articles to third parties except as permitted through the sharing features provided.
  • License for Landing Pages: RealTech grants you a non-exclusive, non-transferable license to use the landing pages within your BoldTrail/kvCORE® account for your business purposes. This license is non-revocable unless you violate these Terms (e.g., by reselling or redistributing the landing pages). You may not share the landing pages or their content.
  • Restrictions: You may not modify, reverse-engineer, decompile, or create derivative works of the Services or their content without RealTech’s prior written consent.
  • DMCA Compliance: RealTech complies with the Digital Millennium Copyright Act (DMCA). If you believe your copyrighted work has been infringed, please follow our DMCA Notice procedure at https://topcoreagent.com/dmca-notice.

5. USER CONDUCT
You agree not to:

  • Use the Website or Services for any unlawful or unauthorized purpose.
  • Attempt to gain unauthorized access to the Website, Services, or any related systems or networks.
  • Interfere with or disrupt the operation of the Website or Services, including by introducing viruses or malicious code.
  • Use the Services to infringe on the intellectual property rights of RealTech or any third party.
  • Resell, redistribute, or sublicense the Services or their content in violation of these Terms.

6. PURCHASES AND PAYMENTS

  • Pricing: Pricing for products and services are as displayed on the Website at the time of purchase. RealTech reserves the right to change pricing at any time, but changes will not affect prior purchases.
  • Payment: You agree to pay all fees associated with your purchase using the payment methods offered on the Website, including WooCommerce, Apple Pay, Google Pay, and PayPal, or any future payment gateway. RealTech does not store credit card or purchase information; such data is handled by these third-party payment gateways.
  • Taxes: While taxes will not be shown or collected in addition to displayed pricing for any product or service on the Website, taxes will be paid by RealTech in accordance with state and/or federal laws.
  • Refunds and Guarantees: Purchases are subject to the refund and guarantee policies outlined in the FAQ page at https://www.topCOREagent.com/FAQ under each product tab.

7. THIRD-PARTY SERVICES
The Services require integration with your BoldTrail/kvCORE® account, a third-party platform. RealTech is not responsible for the availability, performance, or security of BoldTrail/kvCORE® or any other third-party services, including payment gateways (WooCommerce, Apple Pay, Google Pay, PayPal). You are responsible for complying with the terms of service of these third-party platforms.

8. ANTI-SPAM REQUIREMENTS
When using the Services to communicate with your contacts (e.g., sharing articles via email or drip campaigns), you are solely responsible for complying with applicable anti-spam laws, including the U.S. Controlling the Assault of Non-Solicited Pornography and Marketing Act (CAN-SPAM Act) and Canada’s Anti-Spam Legislation (CASL). This includes, but is not limited to, obtaining proper consent from recipients, providing clear opt-out mechanisms, and including accurate sender information in all communications. RealTech Solutions, LLC provides the content and delivery mechanisms (e.g., articles, drip campaigns, and sharing features) but does not monitor or verify your contacts or communications for compliance with these laws. You agree to indemnify RealTech against any claims arising from your failure to comply with the CAN-SPAM Act, CASL, or any other applicable anti-spam laws.

9. DISCLAIMER OF WARRANTIES
YOU EXPRESSLY UNDERSTAND AND AGREE THAT: YOUR USE OF AND RELIANCE UPON THE WEBSITE, SERVICES, AND/OR CONTENT IS AT YOUR SOLE RISK AND IS MADE AVAILABLE ON AN “AS IS” AND “AS AVAILABLE” BASIS. REALTECH MAKES NO EXPRESS OR IMPLIED REPRESENTATIONS, WARRANTIES, OR GUARANTEES WITH REGARD TO THE APPROPRIATENESS, ACCURACY, SUFFICIENCY, CORRECTNESS, VERACITY, VALUE, COMPLETENESS, OR TIMELINESS OF THE WEBSITE, SERVICES, AND/OR CONTENT. REALTECH EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. LIMITATION OF LIABILITY
IN NO EVENT SHALL REALTECH, ITS THIRD-PARTY VENDORS, CORPORATE AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES, OR ANY DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA, OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE WEBSITE OR SERVICES, WITH THE DELAY OR INABILITY TO ACCESS OR USE THE WEBSITE OR SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY CONTENT, SOFTWARE, PRODUCTS, OR SERVICES MADE AVAILABLE OR OBTAINED THROUGH THE WEBSITE, OR OTHERWISE ARISING OUT OF THE USE OF THE WEBSITE OR SERVICES, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF REALTECH HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. ANY SERVICES OR CONTENT MADE AVAILABLE OR OBTAINED THROUGH THE USE OF THE WEBSITE, AND ALL OTHER USE OF THE WEBSITE, IS DONE AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS THEREFROM. 11. INDEMNIFICATION
YOU AGREE TO INDEMNIFY AND HOLD REALTECH, ITS THIRD-PARTY VENDORS, CORPORATE AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS HARMLESS FROM ANY AND ALL CLAIMS AND DEMANDS, INCLUDING, BUT NOT LIMITED TO, REASONABLE ATTORNEYS’ FEES, MADE BY ANY THIRD PARTY DUE TO OR ARISING OUT OF ANY CONTENT SUBMITTED, POSTED, OR OTHERWISE PROVIDED BY YOU TO THE WEBSITE OR SERVICES (E.G., PHOTOS OR LINKS IN BRANDED BANNERS) AND/OR ANY BREACH BY YOU OR YOUR AFFILIATES, EMPLOYEES, AGENTS, OR REPRESENTATIVES OF THESE TERMS.

12. ARBITRATION
Any dispute, controversy, or claim arising out of or relating to these Terms or the Website or Services shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Dixie County, Florida, or another location mutually agreed upon by the parties. The arbitrator’s decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction. You waive any right to participate in a class action or to pursue claims on a consolidated basis.

13. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles, except that any disputes shall be resolved through arbitration as provided in Section 13.

14. MODIFICATIONS TO TERMS
RealTech reserves the right to modify these Terms at any time by posting the updated Terms on the Website. Your continued use of the Website or Services after such changes constitutes your acceptance of the updated Terms. The “Last Updated” date at the top of these Terms indicates when they were last revised.

15. TERMINATION
RealTech will only suspend or terminate your access to the Website or Services if you violate these Terms or if RealTech ceases to operate the Services. Upon termination, your license to use the Services will cease, but provisions that by their nature should survive (e.g., Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification) will continue in effect.

16. PRIVACY
Your use of the Website and Services is governed by our Privacy Policy, available at https://topcoreagent.com/privacy-policy/. For information on opting out of data sales, see our Do Not Sell My Information page at https://topcoreagent.com/do-not-sell-my-information.

17. FORCE MAJEURE
RealTech shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, or government actions.

18. SEVERABILITY
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

19. WAIVER
RealTech’s failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged in writing.

20. NO ASSIGNMENT
You may not assign or transfer your rights or obligations under these Terms without RealTech’s prior written consent. RealTech may assign its rights and obligations under these Terms without your consent, such as in the event of a business sale.

21. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy, FAQ, DMCA Notice, and Do Not Sell My Information pages referenced herein, constitute the entire agreement between you and RealTech regarding your use of the Website and Services and supersede any prior or contemporaneous agreements.

22. NON-AFFILIATION
BoldTrail / kvCORE® is a registered Service Mark for InsideRE, LLC. topCOREagent.com is not affiliated, associated, authorized, endorsed by, or in any way officially connected with InsideRE, LLC, or any of its subsidiaries or its affiliates.
